CONDITIONS OF SALE

1.  All orders accepted on condition that they shall be executed at prices current at the date of delivery.

2. Payment to be made as detailed on invoice, interest of 2% per month or part month to be charged on overdue accounts.

3. Satisfactory trade references are required for new ledger accounts.

4. The time of delivery of all orders and contracts is subject to variation from causes beyond our control such as war, strikes, lock-outs, fire, flood, loss and delay at sea, etc.

5. All delivery times or dates are estimates only. While our best endeavours will be used to despatch within the specified period nevertheless we accept no responsibility for any loss or damage resulting from delays or non delivery,

6. Cancellation cannot be accepted for goods/services requiring special manufacture or ordering.

7. No claims can be entertained unless we are advised in writing of the cause and extent of the same within seven days of delivery of the goods/services.

8. Our liability on goods/services found and agreed to be defective is limited to free replacement of the defective part only. No claim for expenditure upon them or for other consequential damages or losses will be entertained.

9. Goods/services delivered in correct execution of order may on no account be returned without our previous agreement. Failure to obtain this may result in refusal to accept or tender by the carriers.

10. A handling charge of not less than 15% of the invoiced value will be made on all goods/services returned which have been supplied in correct execution of order and which are not defective.

11. Any variation or qualification of these conditions shall not be applicable unless expressly accepted by us in writing.

12. It is an express condition of sale that the sellers have a lien on the goods/services until they are paid for.

13. The conditions of sale are subject to the law of Scotland.

1.    INTRODUCTION

1.2    We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not accept any new terms and conditions after we have given notice, you should not continue to use this Website.

2.    ORDERING FROM US

2.1    Placing an order with us is done by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order confirmation email, detailing the products you have ordered.

2.2    Our acceptance of an order takes place when we despatch the order. When we despatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

2.3    We may refuse to accept an order:
(a) if certain goods are not available;
(b) where it is not possible to obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you fail to meet any eligibility criteria set out in our terms and conditions.

3.    PRICING

3.1    All prices include VAT (where applicable) at the current rates.

3.2    Where we charge separately for shipping and/or insurance and other relevant charges, the appropriate rates are set out elsewhere on this website.

3.5   We reserve the right to adjust prices to cover increases or decreases in cost.

4.     CANCELLATION AND RETURNS POLICY

4.1    If you wish to cancel your order:
(a) you can notify us by email to sales@angus-horticulture.co.uk before we have dispatched the goods to you; or
(b) where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below.

4.2    You can return goods you have ordered from us for any reason at any time within 3 days of receipt for a full refund or exchange. The costs of returning goods to us shall be covered by you. You will need to request a Returns Form (please refer to part 4.6.) In addition to this form, you will receive a label containing the returns address details.

4.4    Faulty items must be reported to Angus Horticulture Limited within three days of receipt of goods. All breakages, shortages or errors must be notified within 24 hours of delivery, or will not be accepted.

4.5   The rights to return the goods to us as referred to in clause 4.3 will not apply in the following circumstances: -

in the event that the product has been used, or is missing the original packing or the original packaging has been damaged.

5.    LICENCE

5.1    You may print and download extracts from this Website for your own use on the following basis:
(a)    no documents or related graphics on this Website are modified in any way;
(b)    no graphics on this Website are used separately from associated text; and
(c)    any of our copyright and trademark notices and this permission notice appear in all copies. 

5.2    Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from this Website other than in accordance with clause 5.1 above for any purpose is forbidden. 13.   SHIPPING AND DELIVERY

13.1   For next day delivery we request that orders are received no later than 0900 hours. We cannot guarantee next day delivery at any time.
